Georgia Firefighter With Heart Attack Awarded Workers Compensation Benefits

Recently, we successfully represented a Georgia firefighter in a workers compensation claim against the county for which he worked. The injury he sustained was a heart attack. Needless to say, the employer denied his claim and took the position that his job had nothing whatsoever to do with the injury to his heart. In researching this injury, we learned that forty percent of on-duty firefighter deaths in the last decade were due to heart attack, according to a recent U.S. Fire Administration report. This is

Workers Compensation Claims/Uninsured Georgia Employers And The Problems They Cause For Claimants

There is an ever increasing problem for many Georgia workers who become injured and disabled as a result of work injuries. The problem is uninsured employers. We recently got a call about a new workers compensation claim from a worker who was seriously injured as a result of a fall. In fact, this worker had been in the trauma unit of a hospital for several months at the time of this call. He had multiple orthopedic injuries, including leg and arm fractures requiring many surgeries.

Atlanta Bus Accident Tragedy Takes 6 Lives

We heard today on a radio broadcast that struck very close to home that four young men from a college in Bluffton, Ohio had been killed, in addition to a bus driver and his wife. Nine others were seriously injured when a charter bus crashed off of an exit ramp off interstate highway I-75 (inside the city limits of Atlanta) back onto the highway. Products liability refers to the liability of any or all parties along the chain of manufacture of any product for damage caused by that product. This includes the manufacturer of component parts, the assembling manufacturer, the wholesaler, and the retail store owner. Another Atlanta Police Chase Case With Fatalities

Just a few weeks ago we blogged about the dangerous nature of police chase cases. See Blog entry entitled High Speed Police Chase Cases: An American Tragedy (2/15/07). Traumatic Brain Injury

In our practice we frequently handle cases involving traumatic brain injuries. Traumatic brain injury can occur in a variety of ways. It can occur when there is a rapid acceleration and/or deceleration of the brain such as in an automobile collision whiplash scenario. Traumatic brain injury can also result when the head comes into contact with another object such as in a motorcycle accident, automobile accident, or a blow to the head. This type of injury is sometimes referred to as a “closed head injury.”

A wrongful death occurs when a person’s death is caused by the wrongful act or negligence of another. A wrongful death is the basis of a lawsuit against the party or parties who cause a wrongful death. Defective Tires

There are many news reports of one car collisions in which a vehicle goes out of control and strikes an object, such as a median barrier or a tree, killing the occupant. While it is only natural to assume that the driver of the vehicle was somehow at fault, this is not always the case. Automobile Accident Victim Trapped in Coma for 23 Years Was Conscious

Automatic Electric Doors At Retail Stores Can Cause Serious Injuries

Regulators Announce New Crib Recall

The Georgia injury lawyers at Finch McCranie, LLP are well aware that there are many dangerous products that come to market. This week Federal Safety Regulators have announced the recall of more than 2.1 million drop-side cribs made by a Canadian manufacturer. It appears that part of the mechanism that allows the rail to slide up and down can break which can allow a child to get wedged between the bed and the rail, resulting in the child’s suffocation and death.

Critical Medical Information Kept Secret

Medical malpractice is a serious problem in Georgia and the United States. While limits on recoveries for innocent victims is being pushed by large insurance companies, there are many issues that are being ignored. One is the lack of information available to the public about incompetent doctors and hospitals.

ERISA Plan Can Disgorge Money From Attorney and Client According To 6th Circuit

The United States Court of Appeals for the 6th Circuit has issued an important opinion in an ERISA case. In Longaberger Co. v. Kolt, No. 08-4432 Nov. 16, 2009. the court held an ERISA plan could enforce its reimbursement rights against an attorney who obtained a personal injury settlement on behalf of an insured.
The attorney negotiated a $135,000 settlement on behalf of a client who was involved in an automobile accident. Only $1,000 remained in his lawyer’s trust account after disbursing $86,000 to the

Volvo Issues Recall For Seatbelt Defect

Our Atlanta automobile product defect attorneys have written many blogs critical of automobile manufacturers for delaying or resisting recalls of dangerous products. Now Volvo deserves credit for quickly and voluntarily issuing a recall due to a dangerous defect. Volvo is recalling 9,667 of its 2010 XC60s, most of them in the United States and Canada, because in a crash test the driver’s seat belt came undone.

Acetaminophen (Tylenol Ingredient) Continues To Kill

We just read of another incident in which an Atlanta area young man died as a result of an “overdose” of acetaminophen, the aspirin-free pain reliever found in Tylenol. Many people believe acetaminophen is one of the safest painkillers on the market. If used properly it is safe, but, it is also the leading cause of acute liver failure in the United States.
Taking just slightly more than the maximum recommended dose for a few days can be toxic, even deadly.
