Dangerous Levels of Cadmium in Chinese Products

Children are being exposed to dangerous chemicals in toys and items manufactured in China. In recent years there have been numerous recalls of goods manufactured in China due alarming safety concerns. However, it seems the Chinese are continuing to flood the US market with dangerous and even deadly products.
Lab testing organized by The Associated Press revealed that cadmium is present in children’s jewelry, sometimes at levels exceeding 90 percent of the item’s total weight. Cadmium is a soft, whitish metal that occurs naturally in

Unnecessary Use Of Tasers Banned By Federal Court

The use of unnecessary force by law enforcement officers is a common and inexcusable problem. Many of the attorneys at Finch McCranie LLP have law enforcement backgrounds and recognize the inherent dangers of police work and the need at times to use force. However, this does not justify the use of unnecessary force.
The United States Court of Appeals for Ninth Circuit has recently issued an opinion addressing this issue in the context of Taser use. The Court, headquartered in California has sent a strong

Polaris Recalls Potentially Dangerous ATV Model

The product liability lawyers at Finch McCranie, LLP pay close attention to the recall of dangerous products that can lead to the wrongful death of innocent people. This week, in cooperation with the U.S. Consumer Product Safety Commission, Polaris Industries has issued a voluntary recall of approximately 8,500 all-terrain vehicles because of a potentially dangerous steering problem, caused by a defective and dangerous front-end component. The recall applies to 2009-2010 models of the Polaris Sportsman ATV. Although there have been no reported

Vicious Dogs Can Be Serious Liability Risk

Georgia injury lawyers know that dog bite incidents often result in very serious injuries and in some cases, death. We have had a number of these cases over the years. The most recent case involved a real estate agent who was attacked by a large dog. Although the dog was tied up at its owners home, it was inadequately restrained by a collar which was itself a defective product. As a result, the dog got loose and literally bit off the entire calf

Dangerous Dehumidifiers Recalled

The Georgia injury lawyers at Finch McCranie, LLP handled a wrongful death case several years ago wherein we represented the family of a young boy who died in a house fire caused by a defective humidifier.
This week it was announced that Home Depot is recalling Chinese manufacture dehumidifiers because they pose a fire hazard according to the U.S. Consumer Product Safety Commission. The recall involves approximately 2,000 Hampton Bay model HB-50 dehumidifiers. The U.S. Consumer Product Safety Commission says that an

Georgia Teenager Struck By Car

As Georgia injury lawyers we have represented many pedestrians who have been struck and seriously injured in automobiles accidents. Just this year we represented a young mother who was crossing a roadway with her two young children when they were struck by a motorist who admitted that she never saw them prior to impact. Unfortunately one of the children died and she sustained serious injuries.
Today it was reported that a car hit an 18-year old pregnant girl and her 4-year old brother

Suing The Government: Pre-Suit Notice Requirements

It is a sad reality that innocent citizens are oftentimes injured by their own government. City and county employees and/or state employees operate vehicles on a day-to-day basis and like other drivers sometimes are guilty of negligence which cause considerable damage to innocent third parties. Because of the expansive conduct of governmental entities in virtually every aspect of our lives, there are many other real life scenarios whereby innocent third party citizens cam be and are injured by the acts of government employees. In such

Important Victim’s Rights Statute Under Review

The Georgia Court of Appeals has recently accepted an Application for Interlocutory Review of a very important victim’s rights statute in this state. Here we refer to a case in which we represent the Plaintiff involving a tolling provision for the statute of limitations for victims of crime. O.C.G.A. § 9-3-99 was enacted as part of the Crime Victims Restitution Act of 2005 and will now be interpreted by the Court of Appals after a ruling in this appeal. Its tolling provision reads as follows:

Two Infant Deaths Lead To Recall Of Amby Baby Motion Bed

The Consumer Product Safety Commission announced that about 24,000 Amby Baby Motion Beds – hammocklike beds have been recalled. According to the Consumer Product Safety Commission the side-to-side shifting or tilting of the hammock can cause an infant to roll and become trapped or wedged against the hammock’s fabric or mattress pad, posing a suffocation risk.. The CPSC has instructed customers to stop using the products immediately.
The beds, made by Amby Baby USA of Minneapolis, Minnesota, were sold online through Ambybaby.com and other retailers

Georgia Bicycle And Pedestrian Accidents

Of all the possible traffic accidents in Atlanta, cases in which vehicles collide with a bicycle or a pedestrian can have the most tragic results. When walking or riding a bike, you do not have the same structural protection against impacts that you do while driving, so you are more likely to be the injured party, and you are more likely to be hurt badly.
If you are severely injured or if a loved one was killed in a bike or pedestrian accident due to

Wrongful Death Damages: The Economic Component

The economic value of a wrongful death claim in Georgia is typically based upon lifetime earnings or the economic value of lifetime services. In a wrongful death case, a plaintiff must prove by a preponderance of the evidence the age of the decedent when he/she died, probable life expectance and yearly income or the value of such services. From such evidence a jury can compute the gross cash value of the deceased’s economic losses based on remaining life expectancy.
In a hypothetical case where

Wrongful Death Damages in Georgia

Among all the 50 states Georgia law is unique because it measures damages in a wrongful death case from the viewpoint of what the deceased lost, not what his or her survivors lost. Under Georgia law, the measure of damages in a wrongful death case is “the full value of the life of the decedent.” See O.C.G.A. §§ 51-4-1(1) and 51-4-4.
The full value of the life of the decedent under Georgia law has two components. First, the economic value of the deceased’s normal

Tort Claims Against Local Government Employees

Here in Georgia, due to the doctrine of Sovereign Immunity, as we have posted before, it is very difficult to sue a local government employee. If a government employee commits a tort against an innocent third party and that person wishes to file a claim against the government employee, the government employee cannot be sued in his or her official capacity unless the employer of the government employee has waived its sovereign immunity. This is because any claim against the employee in his or her

Overcoming Sovereign Immunity Defenses of Counties in Georgia

This past week we spoke at a State Bar seminar on the doctrine of Sovereign Immunity in Georgia. In Georgia, there are limited statutory waivers of sovereign immunity by state and local governments. One of the most frustrating areas is that of county immunity. Essentially, the only statutory waiver of county immunity is that which provides for liability for county vehicles. If a county agent or employee is operating a covered vehicle, there is a mandatory minimum waiver of $500,000.00 per accident/$700,000.00 per occurrence. If

Innocent Pedestrian Killed During High Speed Police Pursuit

On February 5, 2012, a thirty-one year old woman was killed in a residential neighborhood as police officers were pursuing shoplifting suspects. The news accounts do not provide a great deal of information about what the suspects allegedly stole but tragically, again, the question arises in the context of these dangerous pursuits, is it worth risking a human life to apprehend a fleeing shoplifter? Could not other law enforcement techniques have been utilized to apprehend the suspects later, under much safer circumstances? Here, rather

Motorcycle Accidents And The Need For Uninsured Motorist Coverage

In those situations where motorcyclists are involved in automobile collisions, as might be imagined, the injuries sustained can be rather serious. There is no protection other than the helmet for the motorcycle rider. If a motorist fails to yield right-of-way to an oncoming motorcyclist and fails to yield, the results tragically can be either death or very serious injury. What compounds the tragedy is the case where the at fault motorist has either minimum limits of insurance or no insurance at all. In such

The Aftermath Of Tort Reform: Dealing With The Apportionment Statute

In 2005, the Georgia Legislature passed what is known as the Tort Reform Act of 2005. One of the statutes enacted is O.C.G.A. § 51-12-33(c). This provision of the law states that in assessing percentages of fault in any tort action, the trier of fact shall consider the fault of all persons or entities who contributed to the alleged injury or damages, regardless of whether the person or entity was or could have been named as a party to the suit. Thus, in any tort

Tort Claims Against State County And Municipal Governments

Any one who is injured by the acts or omissions of a government agency or employee should understand that there are some hidden traps that could defeat their claims if the law is not followed, in some cases, scrupulously followed. Here we refer to the ante-litem notice provisions required under Georgia law in order to perfect a claim against a government officer or entity. In certain circumstances, if a timely ante-litem notice is not filed, either with a city, county or state government, the

The Impact Of Divorce On Wrongful Death Actions

A divorce is traumatic in and of itself but becomes particularly tragic when either during the divorce or after its conclusion the wrongful death of a child occurs. In such circumstances, the wrongful death claim belongs to the parents jointly. Either one, therefore, has the right to bring the wrongful death claim but if one proceeds unilaterally in doing so, they do so in a fiduciary capacity, meaning that if they ever recover anything, they must hold the monies in trust until such time

The Impact of Pre-Existing Injuries On Personal Injury Case Evaluation

It is not uncommon in our practice to be asked to represent clients in automobile cases who have pre-existing conditions. The closer in time to an accident the pre-existing condition is, the more difficult it is to separate the proverbial “wheat from the chaff” and to prove that the client’s problems arising out of the current accident were either caused by that accident and/or were aggravated by it. While it is not necessary, as a matter of law, to prove that the new injury
