{"id":33673,"date":"2020-10-14T07:00:19","date_gmt":"2020-10-14T11:00:19","guid":{"rendered":"https:\/\/www.finchmccranie.com\/blog\/?p=33673"},"modified":"2020-10-07T16:56:43","modified_gmt":"2020-10-07T20:56:43","slug":"trucking-accidents-and-commercial-vehicle-accidents-in-georgia","status":"publish","type":"post","link":"https:\/\/www.finchmccranie.com\/blog\/trucking-accidents-and-commercial-vehicle-accidents-in-georgia\/","title":{"rendered":"Trucking Accidents and Commercial Vehicle Accidents in Georgia"},"content":{"rendered":"<p>Georgia trucking accidents and commercial vehicle accidents are significantly different than typical motor vehicle collisions that involve two individuals driving privately in vehicles and are not working on behalf of their employer at the time of the wreck.\u00a0 The primary reason for this is that tractor-trailers and other commercial vehicles are governed by the Federal Motor Carrier Safety Regulations, which have also been adopted by the State of Georgia.\u00a0 A \u201ccommercial vehicle\u201d is defined as any vehicle used on the highway or interstate transporting people or property with a gross weight lading of 10,001 pounds or more.\u00a0 This means that if the vehicle, trailer, and load equals more than 10,001 pounds, the vehicle is a \u201ccommercial vehicle.\u201d\u00a0 And subject to the Federal Motor Carrier Safety Regulation (\u201cFMCSR\u201d).<\/p>\n<p>The FMCSR is a comprehensive framework of policies and procedures governing the operation and maintenance of tractor-trailers and other commercial vehicles.\u00a0 Every company that operates commercial vehicles is subject to these regulations and the State of Georgia and all over the Country. \u00a0A company can be held liable for any trucking accident or commercial vehicle accident that resulted from a violation of the FMCSR.\u00a0 Every driver of a commercial vehicle must perform a Pre-Trip inspection which involves inspecting the service brakes, parking brake, steering mechanism, lighting devices and reflectors, tires, horn, windshield wipers, rear vision mirrors, and coupling devices.\u00a0 The driver must document this Pre-Trip inspection and the driver\u2019s employer must maintain these Pre-Trip inspection forms and keep them on file.<\/p>\n<p>For drivers operating commercial vehicles in excess of 26,001 pounds, employers are required to conduct a comprehensive background check of the driver prior to beginning their employment.\u00a0 A driver applying for a job with a trucking company must complete an Application disclosing any moving violations or accidents for the 3-year period prior to the date of application and identifying each employer for whom the driver has worked for the past ten (10) years.\u00a0 In turn, within thirty (30) days of hiring a driver, the trucking company must send written inquiries to the driver\u2019s prior employers for the 3-year period prior to the date of their employment and also must obtain a Moving Violations Report (\u201cMVR\u201d) from any state that has issued a license to the driver for the preceding 3-year period.\u00a0 The driver is also required to undergo an examination by a physician and obtain a Medical Examiner\u2019s Certificate of Fitness.\u00a0 A Pre-Employment Drug and Alcohol Screening is also mandatory.<\/p>\n<div class=\"read_more_link\"><a href=\"https:\/\/www.finchmccranie.com\/blog\/trucking-accidents-and-commercial-vehicle-accidents-in-georgia\/\"  title=\"Continue Reading Trucking Accidents and Commercial Vehicle Accidents in Georgia\" class=\"more-link\">Continue reading<\/a><\/div>\n","protected":false},"excerpt":{"rendered":"<p>Georgia trucking accidents and commercial vehicle accidents are significantly different than typical motor vehicle collisions that involve two individuals driving privately in vehicles and are not working on behalf of their employer at the time of the wreck.\u00a0 The primary reason for this is that tractor-trailers and other commercial vehicles are governed by the Federal [&hellip;]<\/p>\n","protected":false},"author":2,"featured_media":0,"comment_status":"closed","ping_status":"closed","sticky":false,"template":"","format":"standard","meta":{"footnotes":""},"categories":[40],"tags":[44,49,48,50],"class_list":["post-33673","post","type-post","status-publish","format-standard","hentry","category-personal-injury-wrongful-death","tag-personal-injury","tag-tractor-trailer-accident","tag-trucking-accident","tag-wrongful-death"],"yoast_head":"<!-- This site is optimized with the Yoast SEO plugin v27.4 - https:\/\/yoast.com\/product\/yoast-seo-wordpress\/ -->\n<title>Trucking Accidents and Commercial Vehicle Accidents in Georgia &#8212;
