Securities Fraud
Our firm is experienced in representing
individuals and corporations accused of securities
fraud. Three of our partners are former federal
prosecutors, and our firm has used this experience
in successfully representing targets of securities
fraud investigations.
Given the well-publicized allegations of abuses
uncovered in Enron and other corporate investigations,
prosecuting securities fraud has become a very
significant concern for the U. S. Department
of Justice.
In particular, the Department of Justice is focusing
investigative efforts increasingly on the filing
of false financial statements with the Securities
and Exchange Commission when investors are materially misled.
Sarbanes-Oxley has increased the scrutiny of corporate
financial filings by the Securities and Exchange
Commission. Included in its provisions are increased
criminal penalties for those found guilty of participating in schemes to
deceive investors by filing of materially false
statements with the SEC.
Our firm has represented executives in cases before
the SEC in venues from San Francisco to Atlanta,
as well as in investigations involving securities
fraud violations. Here as in other areas, the firm has “real world” experience
representing corporate executives and businesses accused of securities fraud.
